Objective and Scope of our Policy

CAST Group of Companies Inc. (“CAST”) recognizes the paramount importance of your right to privacy and has opted to follow the GDPR rules and regulation for governing our data. We have created this Privacy Policy (“Policy”) to ensure that you are both protected and informed regarding the collection, use, and/or disclosure of your Personal Information (defined below). This Policy applies to the collection of your information from, but is not limited to, www.castgroupinc.com (“Website”), whether that be from a desktop or mobile device, and our suite of software products: WYSIWYG, Vivien, and BlackTrax (“Software Products”).  The collection of your Personal Information could also be in connection with the registration to download one of our software demos, or the purchase or lease of one of our Software Products. We use the Personal Information we collect from you to communicate about the products of your interest, and to help optimize our Website, email marketing and Software Products.

Personal Information

By using our Website and Software Products you may be asked to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, your name, telephone number(s), email address, and/or address (“Personal Information”).

Your Consent

By using our Website or Software Products, you consent to the collection, use and disclosure of your Personal Information by CAST in accordance with the terms of this Policy.  Upon providing reasonable notice to CAST, subject to legal, contractual, and/or other restrictions, you have the right to withdraw your consent to the collection, use and disclosure of your Personal Information. Revocation of your consent may result in our inability to provide you with some or all functionality relating to our Website or Software Products.

Storage and Security of your Personal Information

CAST implements physical, business and technical security measures to ensure the safe-keeping of your Personal Information. To protect your privacy and security, CAST may take reasonable steps to verify your identity prior to providing you the ability to access or update your Personal Information. With specific mention to the Members Only Area (“MOA”) of our Website, you must ensure the accurate recording of your Personal Information so that CAST can identify you to provide you with sales, administrative and/or technical support inquiries. Your Personal Information will only be retained for as long as necessary for the purposes for which it was originally collected, provided retention is no longer necessary for legal, regulatory, or compliance purposes. If we become aware of a security breach we will make our best efforts to inform you within 72 hours, so that you can take the appropriate steps necessary to protect yourself.

Log Data

As a general policy, with the exception of Internet Protocol (“IP”) addresses, no Personal Information is automatically collected through the use of our Website. When you visit our Website, CAST does gather information relating to your IP address and information of a non-personal nature such as: the date and time of your visit, the pages accessed and documents downloaded, the previous site visited that might have referred you to our website, your operating system, and the type of browser you used to access our Website (“Log Data”). When accessing our Website through a mobile device we may also collect the same aforementioned Log Data as well as log data specific to your mobile device, such as your device model, operating system, and device ID. All such Log Data is used in an aggregate form to assist us in determining general usage patterns and to administer, diagnose problems with, and optimize our Website.

Cookies

Cookies are files with small amounts of data, which may include an anonymous unique identifier (“Cookies”). Cookies are sent to your browser from our Website and stored on your computer’s hard drive. We use 4 types of Cookies;

  • Necessary Cookiess – this type of cookie is vital for servers and their applications to work.
  • Preference Cookies – this type of cookie will store your preferences on our website and web apps, such as your preferred language when selected.
  • Statistic Cookies – most of the time these cookies will come from analytics apps, such as Google Analytics, to collect anonymous information for Aggregated Statistics, that will include but not limited to the links you click, pages you visit, and the time you spend on each page

Marketing Cookies – these cookies can be related to social media apps, or related to marketing apps that CAST use, if you sign up to our news or download our demos, you would receive product information from us, and we might use the information collected to understand your interests and send you more relevant content. When visiting CAST’s website, you should be presented with a Cookie Policy footer pop-up message where you need to click to dismiss and to accept this terms and conditions before proceeding to navigate our website. In the same message under “ Show Details”, you have the option to review all cookies used by CAST’s website and you can opt-out to some of these cookies, except the necessary cookies.

Publicly Posted Information

You acknowledge that any Personal Information you post in publicly available sections of our Website, including forums and blogs, can be accessed, collected, or used by CAST and any 3rd party application that CAST uses to help manage our online systems and websites. Please note that if you are using the social networking functions CAST offers, such as our Facebook page: https://www.facebook.com/CASTsoftware/, we may access any of your social network profile information that you have made publicly available on your social network account and we may collect, use, and disclose such information in accordance with this Policy.

Communications

An opt-in is required before CAST can send you any marketing or promotional content via email. Anyone can opt-in when they sign up: via registration forms submitted online, download and test any of our Software Products’ demo versions, to receive CAST news, and/or to become a customer. We may use your Personal Information to contact you with order shipment tracking information, notifications, newsletters, marketing or promotional materials via email. Email communications may be sent by CAST or an authorized agent or dealer of CAST. We use web beacons to collect analytic data from the emails sent to you to track if the email is opened and what embedded links are clicked. You may opt out of these email communications by selecting ‘Unsubscribe’ within the email of any of these communications. Please note that even if you opt-out of certain email communications, we may still need to email you regarding important transactional or administrative information.

Third-Party Sites, Products and Services/Social Sharing

Links or pointers to other sites and references to products and services offered by third parties on our Website are provided to you for convenience. You should be aware that such third-party sites may collect data or solicit Personal Information from you in accordance with their privacy policies. If you use any social sharing function to share our services, your sharing activity will be processed through a third party’s site or service (such as Facebook) in accordance with its governing principles of their privacy policy.

General Disclosure of your Personal Information

We may disclose your Personal Information when you have consented or directed us to do so. However, without limiting the generality of the foregoing, we may disclose your Personal Information without your consent if such information is publicly available. We may disclose your Personal Information to CAST personnel and our business partners, only as necessary, in accordance with the terms of this Policy. In the event of a merger, acquisition, or any form of transfer or sale of some or all of our business, or as part of bankruptcy, liquidation or similar proceeding, your Personal Information may be transferred along with the business.

Disclosure of your Personal Information to Third Parties

Please note that as we do not control third-party sites or services, we are not responsible for their respective privacy policies or the collection, use, or disclosure of any data or Personal Information that such third parties may collect. We do not disclose, share, sell or distribute your Personal Information to unrelated third parties, except under these circumstances:

Revulytics (Malta Ltd.)

Our Customer Experience Improvement Program (“CEIP”) utilizes Revulytics Services provided by Revulytics (Malta) Ltd. within our Software Products. The data collected is used for statistical purposes and feature usage analysis, and sends messages via their software ‘ReachOut’ including text and hyperlinks for display within our Software Products.

The Revulytics software is a call-home system which collects and processes data, which may include your IP address and system and hardware configuration for statistical purposes. Our Software Products may send additional software usage data to the Revulytics software but will send no other Personal Information. This data is then transmitted to a cloud server for storage and/or further processing by CAST and Revulytics and/or Revulytics partners, third-party service providers, and/or corporate affiliates. CAST and Revulytics retain the right to utilize servers located both within and outside the European Union and European Economic Area.

Your IP address is communicated to Revulytics but not retained by them or made available to CAST. However, your IP is supplied to a service that identifies and maintains its geographical origin according to its region via country and state.

We may also collect from you: information pertaining to your feature usage, performance metrics, hardware, and system software (e.g. operating system). You may choose to not participate in this CEIP by opting out during the installation of your Software Product(s). You may cease your participation in this CEIP post-installation by accessing the options menu within our Software Product(s).

Google Inc.

Google Analytics is a web analysis service provided by Google Inc. (“Google”). Google utilizes the data collected to track and examine the use of our Website, to prepare reports on its activities and share them with other Google services. Google may use the data collected to contextualize and personalize the ads of its own advertising network. The data collected from you includes, but it not limited to, cookies and usage data. Mautic – Marketing Automation WebApp

Mautic is a marketing and analytics platform that has the ability to track anonymous aggregated statistics as well as your personal identification if you provide it to CAST. Through Mautic we collect anonymous statistical information from your navigation and we will only identify you when you place an order with us, fill out a form, sign up to a newsletter, download a product demo, or any other way you enter your personal information on our website.

How do we use your information?

We may use the information we collect along with the information you submit to us in the following ways:

  • To personalize your experience and to allow us to deliver the type of content and product offerings in which you are most interested.
  • To send periodic emails regarding your order or other products and services.
  • To follow up with you after correspondence (live chat, email or phone inquiries)
  • To allow us to better service you in responding to your customer service requests.
  • To administer a contest, promotion, survey or other site feature.
  • To quickly process your transactions.

Mautic Opt-out can be done via our Cookies policy agreement message that shows when you first visit our website, under “Show Details” you can opt-out all marketing cookies. If you happen to have already dismissed the Cookie policy message, you can visit our website using your browser’s incognito mode which will trigger the Cookie policy again allowing you to opt out. You can also request to be opted-out by emailing privacy@castgroupinc.com.

Persons Under the Age of Majority

We do not knowingly collect or store any Personal Information about persons under the age of majority. If you believe someone under the age of majority is using our Website or Software Product(s), please contact us at privacy@castgroupinc.com.

Legal Requirements

If the law requires it, we may disclose your Personal Information to a government or counsel in relation to a lawsuit. CAST will notify you or ask you for consent when we are asked to disclose your Personal Information in this manner prior to providing this Personal Information to them unless we’re legally prohibited from notifying you.

Changes to this Policy

This Policy is effective as of May 28th, 2018, and will remain in effect except with respect to any changes to its provisions in the future. Such changes will become effective as per the ‘Last Updated’ date of this document. CAST reserves the right to update or change this Policy at any time. You should periodically check this Policy for any changes. Your continued use of our Website and Software Products after CAST makes modifications to this Policy constitute your acknowledgement of the modifications and your consent to abide by the modified Policy.
